1. Introduction
Welcome to Peza Nyumba ("we," "our," or "us"). These Terms and Conditions govern your use of our website located at peza-nyumba.com and our property listing services (collectively, the "Service").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Service.
Our platform operates in accordance with the laws of the Republic of Zambia, including but not limited to:
- The Estate Agents Act No. 21 of 2000
- The Data Protection Act No. 3 of 2021
- The Electronic Communications and Transactions Act of 2021
- The Lands and Deeds Registry Act
2. Platform Description
Peza Nyumba is an online property listing platform that connects property owners, licensed estate agents, and potential buyers or renters in Zambia. We provide:
- Property listing services for residential, commercial, and land properties
- Search and filter functionality for property seekers
- Communication tools to connect interested parties
- Verification services for listed properties
Important: Peza Nyumba is a listing platform only. We do not act as estate agents, property managers, or intermediaries in property transactions. We do not guarantee the accuracy of listings or the completion of any transaction.
3. User Accounts
3.1 Account Registration
To use certain features of our Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
3.2 Account Types
We offer different account types for individual property owners and licensed estate agents. Estate agents must provide valid registration documentation from the Zambia Institute of Estate Agents (ZIEA) as required under the Estate Agents Act No. 21 of 2000.
4. Property Listings
4.1 Listing Requirements
When creating a property listing, you must:
- Have legal authority to list the property (owner, authorized agent, or property manager)
- Provide accurate and truthful information about the property
- Use only genuine photographs of the actual property
- Disclose all material facts that may affect a buyer's or renter's decision
- Update or remove listings promptly when properties are sold, rented, or no longer available
4.2 Prohibited Listings
You may not list properties that:
- You do not have authority to sell or rent
- Are subject to legal disputes or encumbrances not disclosed
- Contain false, misleading, or deceptive information
- Violate any applicable laws or regulations
- Use photos or descriptions from other properties
4.3 Listing Verification
All listings are subject to our verification process. We reserve the right to request documentation including title deeds, occupancy licenses, or agent credentials. Listings may be rejected or removed if they fail verification or violate our policies.
5. Fees and Payments
5.1 Service Fees
Our platform may charge fees for certain services including subscription plans and contact reveal features. All fees are clearly displayed before purchase and are in Zambian Kwacha (ZMW).
5.2 No Viewing Fees
In accordance with guidance from the Zambia Institute of Estate Agents (ZIEA), clients should never pay viewing fees for properties. Peza Nyumba does not charge or endorse the collection of viewing fees.
5.3 Standard Commission Rates
For reference, standard estate agent commission fees in Zambia typically range from 3% to 5% of the property's selling price. These fees are negotiated directly between agents and their clients and are not collected by Peza Nyumba.
5.4 Refund Policy
Subscription fees are non-refundable except where required by law or in cases of service failure on our part. Contact reveal purchases are non-refundable once the contact information has been revealed.
6. User Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Post fraudulent, misleading, or deceptive content
- Impersonate any person or entity
- Harass, abuse, or harm other users
- Collect user data without consent
- Interfere with the Service's operation
- Circumvent security measures
- Use automated systems to access the Service without permission
7. Intellectual Property
The Service and its original content, features, and functionality are owned by Peza Nyumba and are protected by copyright, trademark, and other intellectual property laws.
By posting content on our platform, you grant us a non-exclusive, royalty-free license to use, display, and distribute that content in connection with providing the Service.
8. Disclaimers and Limitations
8.1 No Warranty
The Service is provided "as is" without warranties of any kind. We do not guarantee:
- The accuracy or completeness of listings
- The quality, safety, or legality of listed properties
- The identity or qualifications of users
- The completion of any transaction
8.2 Limitation of Liability
To the maximum extent permitted by Zambian law, Peza Nyumba shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service or any transaction conducted through it.
9. Indemnification
You agree to indemnify and hold harmless Peza Nyumba, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
10. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we determine violates these Terms, is harmful to other users or the Service, or is otherwise objectionable.
You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease.
11. Dispute Resolution
Any disputes arising from these Terms or your use of the Service shall be governed by the laws of the Republic of Zambia. Disputes shall first be attempted to be resolved through good-faith negotiation. If unsuccessful, disputes may be submitted to the courts of Zambia for resolution.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the new Terms on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.
